            <title>Florida Residents Beware: New Vehicle Ignition Systems May Pose Carbon Monoxide Risk</title>
            <description><![CDATA[<p>Having a car equipped with a keyless system and push button start may be a convenience for some and a cool gadget for others, but regardless, you should be aware of the concerns around owning a keyless system vehicle.  <a href="http://articles.latimes.com/2010/jan/24/business/la-fi-carkeys24-2010jan24">A recent <em>LA Times </em>article</a> raised questions regarding the safety of driving a car with a new keyless system.   The article states that there have been reported concerns including people not being able to <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391939.html">turn off their engines in emergencies</a> and people who unintentionally left their engines running for hours.  </p>

<p>How can it be possible for some drivers to forget they left their engines running?  With all the distractions of life, it could be very easy to forget to press the off button after stepping out of their vehicles.  And while some vehicles warn their drivers that the engine is still running, and some automatically shut off after the driver walks away, some vehicles offer no warning if the engine keeps running after the driver steps away from the car.  If all keyless system vehicles shut off on their own via a timer after the driver leaves the car, not only would this be safer, it would also save gas.  According to the <a href="http://www.chicagotribune.com/classified/automotive/sc-biz-autos-0207-keyless-safety-20100215,0,2370653.story"><em>Chicago Tribune</em>, </a>the National Highway Traffic Safety Administration and the Society of Automotive Engineers are working on standards that would make driving these vehicles safer.  </p>

<p>If your car is left running in the garage, <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394787.html">dangerous carbon monoxide fumes</a> from the vehicle will enter your home, leading to harmful or even deadly consequences.  Carbon monoxide does not have a particular smell or color, so it is difficult to detect unless you already feel some of the symptoms from exposure to carbon monoxide.  Some of these symptoms include feeling weak, dizzy, disoriented, nauseous, and having headaches.  </p>

<p>Causes of carbon monoxide poisoning range from leaving idling vehicles in the garage to having malfunctioning gas heaters at home.  Earlier this year, two Sarasota, Florida, Ringling College students woke up feeling dizzy and disoriented.  They were lucky to have woken up, as they were <a href="http://www.heraldtribune.com/article/20100112/breaking/100119951">suffering from carbon monoxide poisoning</a>.  Six people in total were affected as a result of a defective gas heater in a home that is owned by Ringling College. They were all treated and released from the hospital.  </p>

<p>Not everyone affected by carbon monoxide poisoning is so lucky.  According to the <a href="http://www.cdc.gov/co/faqs.htm">Centers for Disease Control and Prevention (CDC)</a> carbon monoxide poisoning sends over 20,000 people to emergency rooms nationwide and over 400 Americans die from Carbon monoxide poisoning each year.  One of the precautions to take in the prevention of carbon monoxide poisoning includes installing carbon monoxide detectors at home.  </p>]]></description>

            <title>FDA Urges Avandia Recall, Diabetes Drug Linked to Heart Problems</title>
            <description><![CDATA[<p>The popular diabetes drug Avandia has been reported to cause hundreds of heart attacks each month and has also been linked to heart failure. According to a Senate report and as reported by <em><a href="http://www.nytimes.com/2010/02/20/health/policy/20avandia.html">The New York Times</a></em>, the U.S. Food and Drug Administration (FDA) is urging a recall on Avandia because of the health risk associated with the drug.  The reports state that heart failure and heart attacks suffered as a result of Avandia would be prevented if diabetes patients were instead given the drug Actos.</p>

<p>The Senate report says GlaxoSmithKline, the manufacturer of Avandia, was aware of Avandia's health risks for years but did not tell the public.  In 2007, <em>The Journal of the American Medical Association</em> challenged Avandia's safety.  The same year, a scientific study published in the <em>New England Journal of Medicine </em>showed a 43% higher risk of a heart attack from using Avandia.  The pharmaceutical giant stood by its product, saying it was safe.  Not too long after the study, the FDA added a black box warning of Avandia's heart attack risks.</p>

<p>Avandia (Rosiglitazone) has been on the market since 1999 for the treatment of Type 2 diabetes. GlaxoSmithKline continues to stand by its product, claiming there is no link between Avandia and heart attacks.  However, the drug is estimated to have induced nearly 100,000 heart attacks in the 11 years it has been on the market. </p>]]></description>

            <title>Infant Deaths Prompt Nationwide Crib Recall</title>
            <description><![CDATA[<p>The deaths of three babies, all under one year of age, have spurred a nationwide recall of Generation 2 Worldwide and "ChildESIGNS" drop side cribs.  <a href="http://www.cpsc.gov/">The U.S. Consumer Product Safety Commission</a> (CPSC) has recalled these cribs, which are sold in many stores including Walmart, because they pose a threat of death or serious injury.  Parents are advised to no longer use these cribs because babies can suffocate or be strangulated by these <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391939.html">defective products</a>.  The CPSC warns to not try to fix the recalled cribs. </p>

<p>The drop side of these cribs can detach, causing a space where babies have no way of escaping, which can lead to suffocation or strangulation.  In addition to the three deaths reported, several injuries, including bruising and a broken arm, have also been reported to the CPSC.  </p>

<p>Last month Dorel Asia <a href="http://www.flainjurylawyerblog.com/2010/01/deadly-baby-cribs-and-dangerou.html">recalled</a> several crib models because their defective drop sides also posed a threat of strangulation or suffocation.  Around the same time, the CPSC recalled 1.5 million dangerous Graco strollers. </p>]]></description>

            <title>Houston Man Sues Toyota over Accident that Killed his Wife</title>
            <description><![CDATA[<p>When Toyota recalled over 2 million cars last month, it was too late for one Houston family.  Michael Harris is suing Toyota for an accident that caused his wife's death just a week before Christmas 2009.  </p>

<p>Trina Harris was killed instantly when her car ran a stop sign and hit a cement wall on December 18th.  She was driving a 2009 Corolla, one of the vehicles that Toyota recalled in January.  Mr. Harris says his wife had mentioned that her car sometimes sped up on its own.  He wants Toyota to be held accountable for its alleged negligence. </p>

<p>Mr. Harris claims Toyota was aware of the <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391939.html">vehicle defect </a>in the 2009 Corolla his wife was driving but did nothing to fix the problem.  He is also suing the vehicle's gas pedal manufacturer and the company that leased the car to his wife.  Mr. Harris, who serves in the Navy, is now left to take care of his two daughters. </p>

<p>Toyota <a href="http://www.flainjurylawyerblog.com/2009/12/florida-vehicle-alert-toyota-i.html#more">recalled over 4 million cars</a> in November to fix accelerator issues.  Unfortunately, the recall did not involve the 2009 Toyota Camry that Trina Harris was driving.  In January, it <a href="http://www.flainjurylawyerblog.com/2010/02/some-toyota-vehicles-death-thr.html">recalled 2.3 million </a>vehicles because of accelerator problems and soon after that stopped sales in the U.S. on several of its models. </p>

<p>In recent news, Toyota has recalled over 400,000 hybrids, including Prius, around the world because of brake issues.<br />

            <title>Some Toyota Vehicles Death Threats </title>
            <description><![CDATA[<p>After a recent recall that affected 2.3 million vehicles, Toyota has put the brakes on sales of eight of its models in the U.S. because of accelerator problems.  In the latest reports, the recall has just been extended to Europe and China, and possibly Britain as well.  </p>

<p>Toyota Motor Corp. has announced its decision to stop sales and North American production so that the gas pedal issue on the affected models can be fixed.  It is not yet known how many vehicles in Europe or Britain could be recalled.  According to the UK's <em>Guardian</em>, plans for Toyota to stop production at its British plants have not yet been announced, however the company warned that 750 jobs could be cut in the UK.  Toyota also plans to recall over 75,000 RAV4 vehicles made in China between March 2009 and January 2010.  </p>

<p>Toyota has also announced plans to inspect 1.1 million vehicles in the U.S. in addition to the 2.3 million it most recently recalled. </p>

<p>The recalls have been prompted by reports of involuntary acceleration resulting from gas pedal defects.  Toyota <a href="http://www.flainjurylawyerblog.com/2009/12/florida-vehicle-alert-toyota-i.html">previously recalled</a> over 4 million vehicles in the U.S. in November 2009 due to gas pedal issues.  Several car accidents, and some fatalities, were reported from sudden speed caused by defective gas pedals.  U.S. Congress has just announced it will launch an investigation on Toyota's manufacturing problems that may have led to the death of 19 people in the last decade.  </p>

Toyota's former president, Katsuaki Watanabe, admitted to this after a 2006 criminal investigation was conducted by the Japanese government.             <title>Ford Settles Explorer Accident Case that Left Woman Paralyzed</title>
            <description><![CDATA[<p>Ford recently settled for a confidential amount with a woman who was paralyzed in a 2005 collision involving a 2002 Ford Explorer.  This decision came after a jury considered punitive damages and had already ordered Ford to pay over $16 million to compensate for negligently designed rear seats and seat belt structure on the Ford Explorer.  </p>

<p>Lynn Wheeler was a passenger in the Explorer when it was struck head on by another driver.  She was riding in the back seat between the booster seats her grandchildren were sitting in.  The only thing restraining Wheeler was a lap belt.   Upon impact, the rear seat latch broke, causing the back seat to collapse on her.  Her head and neck were pushed forward into the center console, resulting in devastating <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394795.html">spinal cord injuries</a>.  She is now in a wheelchair and on a ventilator.       </p>

<p>Wheeler's lawsuit challenged Ford's decision to install a lap belt instead of a three-point shoulder belt and accused Ford of negligently designing the rear seat latch.  Now, thanks to a law that went into effect in 2007, automobile manufacturers are forbidden from installing lap-only seat belts for rear middle seats.  </p>

<p>Ford argued that it met government safety standards and defended its decision to install lap belts in the Explorer's rear bench seat.  </p>

<p>The jury sided with Wheeler - Ford was ordered to pay over $16 million in damages.  The driver who collided into the Explorer was ordered to pay $1.2 million.  </p>

<p>Ford has been in the press several times in relation to rollover accidents.  A California woman's rollover accident involving her 1997 Ford Explorer is an example of one major case where Ford was under fire for being <a href="http://www.cbsnews.com/stories/2007/11/28/business/main3551632.shtml">prone to rollovers.</a>     The woman sued Ford when the roof on her Explorer collapsed on her during her rollover accident.  She became paralyzed as a result of the spinal injuries she suffered in the accident.  The jury found Ford was aware the roof on the Explorer would collapse during a <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394789.html">rollover accident</a>, and awarded her over $82 million.  </p>

            <title>Deadly Baby Cribs and Dangerous Strollers Recalled</title>
            <description><![CDATA[<p>A major recall is in effect for Dorel Asia cribs and Graco strollers after reports of an infant's death from strangulation in his crib and finger amputations from stroller hinge mechanisms.</p>

<p>A 6-month-old boy from Iowa died of strangulation after becoming trapped in his own crib due to malfunctioning hardware.  The crib was manufactured by Dorel Asia, which has recalled over 600,000 cribs sold by major retailers including Wal-Mart.  The company is recalling 20 models of cribs that can pose a suffocation or strangulation hazard if their drop sides detach.  The cribs also pose a risk of children becoming trapped in the cribs due to broken slats.  The company has received several reports of children being trapped, bruised and scratched due to these cribs.</p>

<p>Following five reports of finger amputations and two reports of cuts due to the hinges in stroller canopies, Graco has recalled 1.5 million strollers manufactured from October 2004 to February 2008.  The recall affects the Spree, Passage and Alano Strollers and Travel Systems.  The manufacture dates can be found above the back wheels, on the lower inside part of the back frame.</p>

<p>The <a href="http://www.cpsc.gov">Consumer Product Safety Commission (CPSC)</a>  announced the strollers present a laceration and amputation threat to children when canopies were opened or closed.  The commission has advised consumers to stop using the strollers and contact Graco to obtain a free repair kit. <br />

            <title>Contaminated Heparin Injury Lawsuits Continue to Mount for Manufacturers</title>
            <description><![CDATA[<p>Heparin manufacturers, including Baxter International, Inc., are facing mounting lawsuits alleging that a known 2008 contamination of the anticoagulant caused severe injuries and deaths.  Lawsuits addressing the <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394776.html">defective drug</a> are being filed in state and federal courts.  The federal court cases are being transferred to multi-district litigation in the Northern District of Ohio.</p>

<p>Heparin is a blood thinner (anticoagulant) used to prevent blood clots in veins, arteries, and lungs, which is often used prior to surgery or as a coating for medical devices.  In 2008, the <a href="http://www.fda.gov/MedicalDevices/Safety/AlertsandNotices/ucm135355.htm">U.S. Food and Drug Administration (FDA)</a> identified an increase in the number of deaths and adverse events, such as anaphylactic-type reactions (allergic reactions) and acute hypotension (extremely low blood pressure), associated with Heparin use.  Scientists identified a contaminate in the Heparin described as oversulfated chondroiton sulfate which mimicked heparin activity and eluded routine testing.  Because of the contamination, the FDA adopted a new standard for testing Heparin in 2009.</p>

<p>Baxter and other manufacturers began recalling suspected contaminated Heparin in 2008.  Investigations have shown that the problem may stem from Chinese producers of crude heparin.  A key ingredient in Heparin is made from pig intestines in China because of the large number of available animals.  Although the source of the contamination has not yet been determined according to <a href="http://www.bloomberg.com/apps/news?pid=newsarchive&sid=aaDmNquvTq1o">reports</a>, some lawsuits are alleging that the China production facilities did not meet U.S. regulation and were not inspected or approved by the FDA.</p>]]></description>

            <title>Humira, Other TNF Blockers Linked to Cancer in Children</title>
            <description><![CDATA[<p>The U.S. Food and Drug Administration (FDA) recently <a href="http://www.fda.gov/NewsEvents/Newsroom/PressAnnouncements/2009/ucm175803.htm">announced</a> that it would require Humira and other tumor necrosis factor (TNF) blocker prescription medications to include its strictest warning on both the packaging and prescribing information for the <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394776.html">potentially dangerous drugs</a>.  The 'boxed warning' or 'black box warning' is now required after analysis of adverse medical incident reports submitted to the FDA showed an increased risk of lymphoma and other cancers with the use of TNF blockers such as Humira, Enbrel, Remicade and Cimzia in children and young adults.  The FDA is requiring that manufacturers warn doctors and patients of the increased risk of leukemia, as well as new-onset psoriasis, on the TNF blocker packaging.</p>

TNF blockers such as Humira, Enbrel, Remicade and Cimzia are used to treat children and young adults with Juvenile Idiopathic Arthritis (also known as Juvenile Rheumatoid Arthritis), Crohn's disease and other diseases.  The drugs work by suppressing the immune system to block the tumor necrosis factor which causes inflammation and immune system related diseases.</p>

<p>The black box warning for TNF blockers comes after approximately 30 reports of cancer in children and young adults under the age of 18 taking TNF blockers were reported to the FDA between 1998 and April 2008.  The concern included the development of lymphoma (cancer of the cells in the immune system) and other cancers such as leukemia, melanoma and solid organ cancers in children taking TNF blockers such as Humira, Enbrel, Remicade and Cimzia.  In August 2009, the FDA announced that it had tracked 48 malignancies from 2001 through 2008 associated with the use of TNF blockers in children after an average of 30 months of treatment.             <title>Paxil Lawsuits Costing Manufacturer Approx. $1 Billion</title>
            <description><![CDATA[Paxil is an antidepressant manufactured by GlaxoSmithKline which is used to treat a variety of psychological disorders including depression, obsessive compulsive disorder, anxiety, and other mental issues.&nbsp; Paxil is a member of a group of drugs known as selective serotonin reuptake inhibitors (SSRI) and is used to balance serotonin levels in the brain.&nbsp; However, since Paxil's introduction on the market in 1993, the potentially <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394776.html">dangerous drug</a> has been plagued with complaints of serious adverse medical events including an increase in suicide rates and attempts, addiction, and birth defects.<br /><br />According to <a href="http://www.bloomberg.com/apps/news?pid=20601103&amp;sid=aEr_s70bGdYo">reports</a>, Glaxo has paid nearly $390 million for suicide death and attempts attributed to Paxil.&nbsp; The family of a Valparaiso, Indiana, boy who killed himself shortly after he started taking Paxil recently settled their suit against Glaxo for an undisclosed amount.&nbsp; In that case and other suicide cases, Glaxo has attempted to blame the suicides on the underlying depression and not the drug itself.&nbsp; However, Glaxo has reportedly settled 150 Paxil-related suicide cases and 300 Paxil-related suicide attempt cases.<br /><br />Paxil has also been linked to severe birth-defects in children whose mothers took the antidepressant while pregnant.&nbsp; In October, a Philadelphia jury found that Glaxo negligently failed to warn doctors of Paxil's risk to pregnant women and found that Paxil caused the heart defect in the three-year-old boy involved in the case.&nbsp; The jury awarded the family $2.5 million in compensatory damages including future medical care.&nbsp; According to <a href="http://www.philly.com/inquirer/breaking/business_breaking/20091013_Glaxo_must_pay__2_5M_in_Paxil_case.html">reports</a>, this case was the first of some 600 lawsuits against Glaxo for failing to warn of Paxil's dangers to pregnant women.&nbsp; Glaxo has reportedly settled 10 other birth-defect cases to date.<br /><br />Paxil has also been accused of causing addiction and severe withdrawal effects for those attempting to quit the drug.&nbsp;&nbsp; According to reports, Glaxo has settled nearly 3,200 cases involving addiction-related complaints and complications.<br /><br />]]></description>

            <title>Davie, Florida Man Severs Leg in Airboat Accident</title>

            <title>Florida Vehicle Alert: Toyota Issues Massive Defect Recall</title>
            <description><![CDATA[<p>Toyota has recently announced a <a href="http://pressroom.toyota.com/pr/tms/toyota/toyota-consumer-safety-advisory-102572.aspx">recall</a> of several models of both Toyota and Lexus vehicles that is estimated to affect some 4.26 million vehicles throughout the United States and Canada.  The recall comes because of complaints that the gas pedal in these vehicles can become stuck in the depressed position causing uncontrolled acceleration.&nbsp;  <a href="http://www.latimes.com/business/la-fi-toyota-recall26-2009nov26,0,3295310.story?page=2">According to reports</a>, this "pedal entrapment" has been blamed for the deaths of 19 people since the 2002 model year.&nbsp; The problem was initially thought to be caused by mispositioned floor mats, but the recall goes beyond floor mats and addresses design issues of the gas pedals, floor board, and computer system.</p><p>The initial recall of <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391873.html">potentially defective Toyota and Lexus vehicles</a> began in September when Toyota warned that owners of specific models should immediately remove the floor mats to help prevent unanticipated acceleration from pedal entrapment.&nbsp; This most recent recall includes Toyota technicians physically modifying the gas pedal to reduce the length by three-quarters of an inch, replacing genuine Toyota or Lexus all-weather floor mats, and installing a brake override system that will cut engine power when both the accelerator and the brake are pressed at the same time.&nbsp; Some vehicles will also have the padding beneath the gas pedal replaced with a thinner pad to increase clearance between the pedal and the floorboard.</p><p>The latest rounds of repairs are scheduled to begin January 2010 and are estimated to exceed $250 million in parts and labor.&nbsp; The potentially defective pedals that are modified during this time are anticipated to be replaced by properly manufactured parts when they become available.&nbsp; The brake override system, which is often referred to as "smart pedal" technology and utilized by other auto manufacturers, is scheduled to be implemented as standard equipment on all Toyota and Lexus vehicles manufactured after January 2010.</p><p>Although Toyota seems to deny that an actual defect exists in the affected vehicles, the National Highway Traffic Safety Administration (NHTSA) released a <a href="http://www.nhtsa.dot.gov/portal/site/nhtsa/template.MAXIMIZE/menuitem.f2217bee37fb302f6d7c121046108a0c/?javax.portlet.tpst=1e51531b2220b0f8ea14201046108a0c_ws_MX&amp;javax.portlet.prp_1e51531b2220b0f8ea14201046108a0c_viewID=detail_view&amp;itemID=38d803e5fa0c4210VgnVCM1000002fd17898RCRD&amp;pressReleaseYearSelect=2009">statement</a> to correct what it described as "inaccurate and misleading information" being propagated by Toyota.&nbsp; The NHTSA stated that removing the floor mats in these <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391873.html">potentially dangerous vehicles</a> was only an interim measure and did not correct the underlying defect in the vehicle which causes pedal entrapment.&nbsp; The NHTSA assured consumers that it would continue to investigate the issue until the defect is corrected with a vehicle-based solution.<br /></p>]]></description>

            <title>FDA Recalls Defective Synex II Vertebral Body Replacement after Failures</title>
            <description><![CDATA[<p>The U.S. Food and Drug Administration (FDA) has issued a Class I recall of Synthes USA's Synex II Vertebral Body Replacement.  The Class I recall is the most serious recall and was issued because the medical device presents a reasonable probability of serious injury.  The <a href="http://www.personalinjuryfirm.com">defective medical device</a>, which is used to replace damaged vertebrae in the thoracic and lumbar spine, may fail after implantation causing a loss in the vertebral body replacement height.</p>

<p>According to the FDA, the failure of the device can lead to neural injury, pain, kyphosis, and the need for corrective surgery.  Because of the danger associated with this defective medical device, surgeons and hospitals have been ordered to cease using the vertebral body replacements immediately.  The <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1391939.html">defective products</a> subject to recall were manufactured from June 2007 through September 2009. <p>Action by the FDA comes after Synthes USA began recalling the Synex II device in September amidst six adverse incident reports of the vertebral body replacements' failure.  Patients with increased pain or other symptoms are advised to contact their surgeon for evaluation.  Patients can report adverse incidents to the <a href="http://www.fda.gov/Safety/MedWatch/default.htm">MedWatch Adverse Event Reporting</a> program established by the FDA.</p>]]></description>

            <title>Fort Lauderdale, Florida Train Accident Kills Two, Critically Injures Another</title>
            <description><![CDATA[<p>A South Florida Tri-Rail train crashed into a car on Thursday at the Commercial Boulevard crossing in Fort Lauderdale, Florida.&nbsp; The crossing is located between Commercial Boulevard's extremely busy intersections with Powerline Road and Interstate 95.&nbsp;  According to reports, the car stopped on the tracks as the crossing arms lowered around the vehicle. &nbsp; The driver attempted to reverse off the tracks, but was prevented by the crossing arms.&nbsp;  The driver then tried to pull forward out of the path of the train, but did so too late and was dragged some 60 feet after the train impacted the side of the vehicle.&nbsp; Two people were thrown from the vehicle and died at the scene, while a third occupant was taken a local hospital for treatment of the <a href="http://www.personalinjuryfirm.com/lawyer-attorney-1394799.html">severe injuries sustained after the train accident</a>.</p>

<p>Although the accident is still under investigation, reports claim that witnesses at the scene told investigators that warning lights were flashing at the time of the accident.&nbsp; The <a href="http://www.miamiherald.com/news/broward/story/1342979.html">Miami-Herald reported</a> that traffic often backs up onto the tracks at the Commercial Boulevard crossing especially during rush hour.&nbsp; According to the report, there have been seven accidents at this specific crossing which resulted in three deaths and two injuries since 1989 despite unsuccessful or unimplemented experimental safety measures including cameras to warn conductors of vehicles in the crossings.&nbsp; Statewide in 2007, there were 90 accidents at rail-road crossings between trains and cars or pedestrians that resulted in 20 fatalities and 63 injuries in Florida according to the U.S. Department of Transportation State Transportation Statistics.<br /></p>]]></description>
